A KIDDERMINSTER teenager has been jailed for raping and sexually assaulting a child, an attack filmed in part by a friend.

Joseph Biddle was found guilty by a jury of raping the girl aged under 13 in Kidderminster after admitting a sexual assault on the same complainant on the same day.

Biddle, now aged 19, of Worcester Road, Kidderminster was a youth aged 17 when he carried out the rape and sexual assault.

He appeared via video link at Worcester Crown Court on Tuesday where he was jailed by recorder Martin Butterworth.

The public gallery was filled with Biddle's family and friends. There were angry shouts at the recorder's sentencing remarks and he warned them that if they were not quiet he would clear the gallery.

The incidents both happened in November 2016 after Biddle contacted the girl through social media.

The court heard how Biddle first sexually assaulted the girl, an assault filmed by one of Biddle's friends on a mobile phone, before Biddle raped her, an incident which lasted up to 15 minutes.

No protection was used and the girl later feared she might be pregnant.

Lisa Hancox, defending, said that her client was of previous good character, had a mild learning disability and had struggled to 'find where he fits in in society' and form relationships.

Miss Hancox asked the judge to take into account the defendant's age at the time of the offence - 17 years old - although she conceded he was days away from turning 18.

Recorder Martin Butterworth said: "You gave her attention which flattered her as, no doubt, you intended it to. At various stages you claimed you did not know she was 12."

But recorder Butterworth said Biddle made no enquiries to discover her age and added: "That is because you did not care how old she was. Your focus was on what you wanted."

He said factors that increased the seriousness were the filming of the sexual assault, the presence of others and that one of Biddle's friends had taken steps to make sure that he and the girl were not interrupted.

However, he balanced against that Biddle's lack of previous convictions and his age at the time the offences were committed.

The psychological report showed Biddle had ADHD but not autism as he had claimed. There had also been a diagnosis of conduct disorder, a mild learning disability and oppositional defiant disorder.

The recorder acknowledged that Biddle had not used force but had encouraged the complainant to like and admire him.

"She was immature and vulnerable to your attention which you exploited with determination. The harm you have done is very significant" the recorder told him.

The recorder made an indefinite sexual harm prevention order and imposed a restraining order in relation to the complainant prohibiting direct or indirect contact. This will also last until further order.

Recorder Butterworth ordered Biddle to be detained for six years in a young offender institution.
