A MAN confronting his ex-wife about seeing other men, smashed the glass in a door injuring himself and another, a court heard.

When Tyrone Austin thought he saw his wife in the car with another man without their three children on May 31, he responded in anger.

Clare Linehan, prosecuting, said the offence came after Faye Titley, who the 39-year-old was with for 13-and-a-half years, asked him to look after their children, which he did at her home address where he stayed for a week after.

"On May 31, Mrs Titley was helping the defendant to move items into a new address of his own," she said.

"It was on that day that Mr Austin thought he saw his wife drive past in a car with another man. Their children were not in the car.

It then Austin, of Avon Road, Kidderminster, went to his ex-father-in-law's home, Clive Titley, who he thought might have had his children.

"He walked up the drive and was shouting," Ms Linehan said. "He asked where [Mrs Titley] was and shouting about her. She came out and described im as shouting at her. Her father came out and ushered her back inside.

"They were back inside the house and had closed the door to keep [Austin] out. He punched through the glass, reaching for the keys. A piece of glass struck Mr Titley."

After Austin left the property, he was seen by a police officer with a bleeding hand, which he had seriously injured on the glass of the door. The officer stopped to help him, asking him to put his hands behind his back so he could examine the wound, but quickly put handcuffs on his left hand.

Ms Linehan said when the officer tried to put them on his right hand, the defendant swung a the officer causing cuts, abrasions, and blisters to his neck, chest, arms and hands.

In mitigation, David Howarth said the defendant was concerned for the welfare of his children and had no intention of having a confrontation with Mr Titley.

It was accepted that the offences were as a result of recklessness and were not intended.

Austin pleaded guilty to assault by beating, criminal damage, and the assault of a PC when he appeared at Kidderminster Magistrates' Court on Thursday, October 23.

District Judge Nigel Cadbury sentenced him to a 12-month community order, with a supervision requirement and a 12-week electronic curfew for between 9pm and 7am.

He was also ordered to pay £100 compensation to both the injured parties, a £60 victim surcharge and £85 in court costs.

Clive and Faye Titley were granted a restraining ordered against Austin for two years.
